Board gives Beachbrook Farm developer one more month

Middleton Planning Board gives the stalled Beachbrook Farm subdivision one final month to produce a signed covenant. Attorney Matthew Gunter, representing lender Cardinal Capital Group, asked the board to loosen covenant language so the mortgage holder could sell the unfinished property to another developer if it forecloses, rather than only to a homeowner. Town counsel Jay Tallerman agreed to draft revised terms but said occupancy of unbuilt lots must wait until road and site infrastructure is complete.

Board members cited roughly $26,000 to $30,000 in unpaid property taxes and an unpaid $12,000 engineering bill blocking release of the road's as-built survey. The board voted unanimously to continue the hearing to October 14, warning that failure to reach agreement by then would prompt rescission of the subdivision. Separately, the board opened a study of proposed zoning bylaw amendments, including eliminating the "fast food restaurant" definition and shifting special permit authority to the Zoning Board of Appeals, and voted to move its meeting start time to 6:30 p.m. beginning in January 2027.
